Trademark Registration for Companies and Corporations

A trademark is a commercial asset whose protection should be planned before, during and after the filing process. A company's brand should be registered in the name of its intended owner. Founders sometimes register marks personally although the company finances and uses them.

What to keep in mind

Review the legal entity, shareholding arrangements, actual use and possible licenses or transfers, coordinating ownership with contracts and future investment.

A mark held by a former shareholder may become a major dispute even when the company created its commercial value.

Distinctions often confused

A registered corporate name does not automatically grant trademark rights.

Frequently asked questions

Must the trademark belong to the company manager?
No. Ownership should be deliberately allocated and documented.
Can a founder transfer a personally registered mark to the company?
Generally yes, through the appropriate agreement and INPI registration procedure.
